End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you

("User") and Quantum Surprise, Unipessoal, LDA ("FoCoCo", "we", "our"), governing

your use of the FoCoCo mobile app, associated web services, and all content, tools, and

features provided therein ("the App").

By downloading, installing, accessing, or using the App, you agree to be bound by these

1. License Grant

FoCoCo grants you a limited, revocable, non-exclusive, non-transferable, and non-sub-

licensable license to use the App for personal, non-commercial purposes in accordance

with this Agreement.

You may not:

• Copy, modify, or create derivative works of the App

• Reverse-engineer, decompile, or disassemble any part of the App

• Use the App for any illegal or unauthorized purpose

• Circumvent or disable security features or usage limits

2. User Eligibility

The App is intended for individuals aged 13 and older. If you are between 13 and 16 years

of age, parental consent is required. By using the App, you confirm that you meet these

requirements.

3. Account Registration & Access

• You agree to provide accurate, complete, and updated information during

registration.

• You are responsible for maintaining the confidentiality of your login credentials.

• You may not share your account with others.

• FoCoCo reserves the right to suspend or terminate accounts found in violation of

these terms.

4. Subscription & Payment

FoCoCo offers tiered subscription plans (Basic, Plus, Prime) through the Apple App Store

and Google Play Store.

• Payments, renewals, and cancellations are handled via your app store account.

• Certain tiers include access to AI features and coaching modules.

• Unused tokens or credits expire if not used within the billing period.

5. Intellectual Property

All content, design elements, graphics, text, and software within the App are owned by or

licensed to FoCoCo and protected by intellectual property laws.

You may not reproduce, distribute, or publicly display any part of the App without express

written permission.

6. AI-Powered Features

Some features in FoCoCo rely on OpenAI API services. By using these features, you

acknowledge that:

• AI-generated content is for informational and educational purposes only

• You remain responsible for interpreting and applying coaching insights• FoCoCo is not liable for decisions or outcomes resulting from AI-generated guidance

7. User Content

By submitting journal entries, feedback, or performance logs, you grant FoCoCo a non-

exclusive, royalty-free license to use this data solely for:

• Personalizing your experience

• Generating insights via AI

• Improving the App’s coaching and analytical features

You retain full ownership of your data and can export or delete it anytime.

8. Acceptable Use

You agree not to:

• Upload or transmit any unlawful, harmful, or abusive content

• Interfere with or disrupt the App’s functionality or infrastructure

• Use the App in ways that violate the rights or privacy of others

Violation may result in termination of your access.

9. Disclaimers & Limitation of Liability

FoCoCo provides its services “as-is” without any warranties of accuracy, fitness, or

performance.

To the fullest extent permitted by law, FoCoCo is not liable for:

• Losses arising from your reliance on coaching content or AI insights

• Errors in data logging, syncing, or personalized recommendations

• Temporary service interruptions or data loss

10. Termination

You may delete your account at any time from within the App. FoCoCo reserves the right

to suspend or terminate accounts for violation of this Agreement.

Upon termination:

• Your license to use the App ends

• Data may be retained as per our [Privacy Policy] unless deleted by you

11. Governing Law & Dispute Resolution

This Agreement is governed by the laws of Portugal. Any dispute shall be submitted to the

exclusive jurisdiction of the courts located in Lisbon, Portugal.

12. Modifications to Terms

We may update this Agreement from time to time. Changes will be posted in-app and on

our website. Continued use constitutes acceptance of the updated terms.
